What if someone developed an app for Peggy that "downloaded music from the LMA and saved it on her ipod so she can listen to them when not online"? Wouldn't the App developer have to give the App away for free - no commercial gain or profit, right? What do you think?
What if adding shows from the LMA to your iPhone was too complicated for you to do? What if you wanted to pay me a small stipend to put LMA downloadable shows on your iPod? I would have to do this for free - no commercial gain or profit, right? What do you think?

The Grateful Dead and our managing organizations have long encouraged the purely non-commercial exchange of music taped at our concerts and those of our individual members. That a new medium of distribution has arisen - digital audio files being traded over the Internet - does not change our policy in this regard. Our stipulations regarding digital distribution are merely extensions of those long-standing principles and they are as follow:
No commercial gain may be sought by websites offering digital files of our music, whether through advertising, exploiting databases compiled from their traffic, or any other means.
All participants in such digital exchange acknowledge and respect the copyrights of the performers, writers and publishers of the music.
This notice should be clearly posted on all sites engaged in this activity. We reserve the ability to withdraw our sanction of non-commercial digital music should circumstances arise that compromise our ability to protect and steward the integrity of our work."

I think you could charge a few bucks for a tutorial on how to do this with any band's files from LMA. Thus, GD policies regarding profit would not apply. Then Peggy can take that knowledge and apply it to adding GD shows/files to her Ipod/phone.
In any case, I think charging Peggy for your time and know-how is not the same as profiting from distribution of GD MP3 files uploaded here at LMA. It's kind of a grey area and I don't think anybody would mind unless you offered this as a service via a website like E-Bay or Craigslist.

FWIW, there are a few paid apps that serve as an interface to the LMA. There are free ones too, but the paid apps have, to this point, not run afoul of whatever non-profit band decrees there are out there.
