Because the terms of service is a bit too complex, there is no clear answer. Care to elaborate?

If not, then what I will say, is to create a completely separate website variant to the Internet Archive that can be used to archive this sort of content, with the obvious exclusion being child pornography. Can this be taken on board?

Jeff Kaplan's answer certainly was unnecessarily vague. What he meant to say was, 'I'd strongly suggest you email info@archive.org before uploading.'

Long story short, even archive bodies are not beyond critique, since the Internet Archive's policies are quite too complex and hard to easily understand.
